Hello Poppyseeds! So I have just found something big, as I was talking to the lovely YouTuber on Twitter, RepZilla. He shared with me some information about a website called upsto.gov which is owned by the United States if you search up UMG which is Island Records on the website one of the results that will come up is a PDF which seems by one of the members of Island like a Q&A about copyright. This is the link to the pdf: https://www.uspto.gov/sites/default/files/documents/Association_of_American_Publishers_Comments.pdf . Association Of American Publishers is another company owned by Island. I came across one of these defintions as it reads " Derivative work” is defined as: “a work based upon one or more preexisting works, such as atranslation, musical arrangement, dramatization, fictionalization, motion picture version, soundrecording, art reproduction, abridgment, condensation, or any other form in which aworkmay be recast,transformed, or adapted.The statutory definition goes on to say that “[a] work consisting of editorial 3revisions, annotations, elaborations, or other modifications, which, as a whole, represent an originalwork of authorship, is a ‘derivative work.’” All of this means that if you repost a video of Moriah, it falls into the category of "Derivative Work" and therefore they cannot take it down as it is previous work of Island and techinally all the old Moriah videos are owned by Island. Which makes no sense as this is hipocrisy and I'm pretty sure is illegal too. But since Poppy left Island, where does this stand? A company owned by Titanic Sinclair called Titanic Sinclair Productions rarely takes down Moriah related videos, what this is doing is technically illegal as they do not own the videos, Island does but reposting the works before Poppy signed to Island makes it Derivative Work. I know all of this is confusing, but no one technically has the right to take down Poppy's videos. As it falls under Derivative Work. I know you're probably thinking "But MarsDy! Reposting the video isn't recreating." you're right but also wrong. You see when you take that video, you're recreating another file that was prior to Poppy's signing to Island. So, it falls under your own work technically. And if you're making a video containing the audio of Moriah song/ video. That should be allowed, as it's prior to Moriah's works with Island. I would like to thank RepZilla so much for sharing the link to help me come to this conclusion. Unfortunately, UMG and Titanic do not listen to this and I'm sure that they have forgotten that this exists. If you have some corrections for me to make to this information, please let me know.
